Terms and Conditions

1. Prize information and instructions in promotional material form part of these terms and conditions.
2. By entering this competition you agree that you have read, understood and accepted these terms and conditions.
3. Entry is open to all New Zealand residents except employees of Fonterra Brands New Zealand ("The Promoter"), their associated companies, immediate families, employees of participating retailers or agencies associated with this promotion.
4. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is in breach of the terms and conditions of the promotion. Such entrants will remain liable for any text costs. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's decision is final in all maters and no correspondence will be entered into.
5. No responsibility will be taken by the Promoter for non-receipt of an entry for any reason. Such entrants will remain liable for any text costs.
6. The promotion will commence from 21 September through to midnight on 15 November 2009. Entries must be submitted within these times.
7. Entry is only by text SMS and is at the cost of the participant. Competition is open to all mobile networks. Standard 20 cents inc. GST text rates apply from all service providers.
8. There are two prize sections. To enter the Hannah Montana section, purchase any promotional pack of CalciYum Hannah Montana 12 X 100g pack of dairy food from any participating store during the designated period. Text the unique 8 digit code printed on the underside of your 12-pack sleeve to 4488.
9. To enter the BEN10 prize section, purchase any promotional pack of CalciYum BEN10 12 X 100g pack of dairy food from any participating store during the designated period. Text the unique 8 digit code printed on the underside of your 12-pack sleeve to 4488.
10. Each Hannah Montana pack code is unique and can only be entered once into the Hannah Montana section and each BEN10 pack code is unique and can only be entered once into the BEN10 section. Consumers may enter the competition as many times as they like, provided they purchase and submit a different valid code from each promotional pack purchased.
11. The person whose mobile phone is used to send the entry is deemed the entrant and eligible prize recipient.
12. All prizes are non-transferable and cannot be exchanged for cash. The Promoter reserves the right to a substitute prize or prizes with those of equal or greater value should any prize or part of a prize package be unavailable for any reason.
13. There are 2256 prize draws in total, 2240 minor daily prize draws and 16 major weekly prize draws. Half of all minor and major prize draws will be drawn from the Hannah Montana entry section and the other half of all prize draws will be drawn from the BEN10 entry section.
14. Forty minor prize draws will be conducted daily, twenty from all Hannah Montana entries received on the preceding day, and twenty from all BEN10 entries received on the preceding day. Minor prize draws will commence from Tuesday 22 September for fifty six consecutive days, with the final minor daily prize draw taking place on Monday 16 November, 2009. Each minor prize is for a Hannah Montana or BEN10 dairy food chilly sleeve and will be awarded to the first twenty eligible winners in each of the two entry sections. Entries for all minor prize draws must be received the day before each scheduled minor prize draw to be eligible to participate in that draw and are valid for that draw only plus the major weekly prize draw at the end of every week of the promotion.
15. The major weekly prize draws will commence on Monday 28 September from all valid entries received over the previous week, for eight consecutive weeks through to the final major weekly prize draw on Monday 16 November, 2009. Two major prize draws will be conducted weekly, one from all Hannah Montana entries received over the previous week, and one from all BEN10 entries received over the preceding week. The first eligible winner drawn from the Hannah Montana section each week will win a Teac 9" Portable DVD Player model DVP950, a Hannah Montana "The Movie" DVD and Hannah Montana "Best of Both Worlds" 3-D DVD and a Hannah Montana Movie CD soundtrack. The first eligible winner drawn from the BEN10 section each week will win a Nintendo DSi gaming console, a BEN10 "Alien Defence Force" Nintendo game, "Kevin Levin's Action Cruiser" toy car and a BEN10 "Alien Force" DVD.
16. All draws are final. No correspondence will be entered into. All winners will be notified by phone. Winners will be asked to verify their physical address for delivery of prizes. If the Promoter or their designated agents are unable to make contact with any winner having attempted to contact them by landline or mobile at least three times and left messages where possible, they reserve the right to re-draw and re-allocate the prize to another entrant after 3 days following the date of the draw.
17. All winners of daily minor prize draws remain eligible for that week's major prize draw. Should insufficient entries be received for the number of prizes scheduled to be drawn in any minor daily or major weekly prize draw, then those left over prize(s) will be carried forward and awarded on the next equivalent draw date.
18. Prizes will be delivered within two weeks of winners providing their address information. The Promoter holds no liability for prizes lost in transit either via postal or courier services.
19. If a prize winner is a minor, the prize may be awarded, at the absolute discretion of the Promoter, to their parent or legal guardian.
20. By entering, winners agree to the use of their name, locality and photograph for publicity purposes without further compensation.
21. The promoter makes no warranties or representation regarding the prizes.
22. All entries remain the property of the Promoter and will be held in a database until the conclusion of the promotion, after which time, they will be destroyed.
23. The Promoter reserves the right to cancel the promotion at any time.
